12.08.2009 hearing on land court NBG

Case dismissed

written judgement land court NBG

Oral Statement:

"The fertilization was not done yet, because the egg cell and the sperm were still in the so named preliminary stage. If the clinic would make the usage of the cell possible it would criminalize because of the embryo protection law.

"One cannot make an illegal action in Germany possible in a foreign country, also if it is legal there."

"Similar problems exist at present time with soldiers, who freeze sperm and egg cells with their partners, before they accept any military activity in a foreign country."

"With the unfreezing the process (of fertilization) it will reflate and the hospital will be liable for prosecution."

"The fertilization is by medical terms finished after the unfreezing process. The freezing process was done shortly after the sperm has intruded into the plasma of the egg cell and the cell nuclei were not conglomerated yet. The release would therefore be an aid to a criminal act."
